Important Notice: Lik-Sang.com Out of Business due to Multiple Sony Lawsuits
Tue Oct 24 2006 21:58:51 Hong Kong Time - Corporate Info

FOR IMMEDIATE RELEASE - OUT OF BUSINESS NOTICE

Hong Kong, October 24th of 2006 - Lik-Sang.com, the popular gaming retailer from Hong Kong, has today announced that it is forced to close down due to multiple legal actions brought against it by Sony Computer Entertainment Europe Limited and Sony Computer Entertainment Inc. Sony claimed that Lik-Sang infringed its trade marks, copyright and registered design rights by selling Sony PSP consoles from Asia to European customers, and have recently obtained a judgment in the High Court of London (England) rendering Lik-Sang's sales of PSP consoles unlawful.

As of today, Lik-Sang.com will not be in the position to accept any new orders and will cancel and refund all existing orders that have already been placed. Furthermore, Lik-Sang is working closely with banks and PayPal to refund any store credits held by the company, and the customer support department is taking care of any open transactions such as pending RMAs or repairs and shipping related matters. The staff of Lik-Sang will make sure that nobody will get hurt in the crossfire of this ordeal.

A Sony spokesperson declined to comment directly on the lawsuit against Lik-Sang, but recently went on to tell Gamesindustry.biz that "ultimately, we're trying to protect consumers from being sold hardware that does not conform to strict EU or UK consumer safety standards, due to voltage supply differences et cetera; is not - in PS3's case - backwards compatible with either PS1 or PS2 software; will not play European Blu-Ray movies or DVDs; and will not be covered by warranty".

Lik Sang strongly disagrees with Sony's opinion that their customers need this kind of protection and pointed out that PSP consoles shipped from Lik-Sang contained genuine Sony 100V-240V AC Adapters that carry CE and other safety marks and are compatible world wide. All PSP consoles were in conformity with all EU and UK consumer safety regulations.

Furthermore, Sony have failed to disclose to the London High Court that not only the world wide gaming community in more than 100 countries relied on Lik-Sang for their gaming needs, but also Sony Europe's very own top directors repeatedly got their Sony PSP hard or software imports in nicely packed Lik-Sang parcels with free Lik-Sang Mugs or Lik-Sang Badge Holders, starting just two days after Japan's official release, as early as 14th of December 2004 (more than nine months earlier than the legal action). The list of PSP related Sony Europe orders reads like the who's who of the videogames industry, and includes Ray Maguire (Managing Director, Sony Computer Entertainment Europe Ltd), Alan Duncan (UK Marketing Director, Sony Computer Entertainment Europe Ltd), Chris Sorrell (Creative Director, Sony Computer Entertainment Europe Ltd), Rob Parkin (Development Director, Sony Computer Entertainment Europe Limited), just to name a few.

"Today is Sony Europe victory about PSP, tomorrow is Sony Europe’s ongoing pressure about PlayStation 3. With this precedent set, next week could already be the stage for complaints from Sony America about the same thing, or from other console manufacturers about other consoles to other regions, or even from any publisher about any specific software title to any country they don’t see fit. It’s the beginning of the end... of the World as we know it", stated Pascal Clarysse, formerly known as the Marketing Manager of Lik-Sang.com.

"Blame it on Sony. That's the latest dark spot in their shameful track record as gaming industry leader. The Empire finally 'won', few dominating retailers from the UK probably will rejoice the news, but everybody else in the gaming world lost something today."

Shouldn't this be in off topic?

I don't see a real problem with it.  Sony can do what they like and I'd prefer to wait for an official release anyway.  Means they can probably sort out any problems with the machine by the time the UK gets it...and by the time I can afford one...

My PS2's done me well for the last 5 years or so anyway so I don't need to upgrade anytime soon.

What a bunch of greedy hypocrites. Sony just wants to fully exploit the UK's massively high prices, which Lik Sang did away with. All those safety excuses are a load of bollocks.

It's no big deal. The people will always find a way to get around stuff like this. Somebody is going to replace Lik-Sang, or they'll open up yet again. (They got closed down a couple of years ago by the Chinese.)

If the people can't find a way around it, they won't take it. It's about to happen in the US with DRM, internet tolling, BlueRay self destruct, HD encryption, etc. All these technological limitations are going to go down in flames once the average Joe finds out just how hard corporations and the government are trying to screw them.

NOW thread this should be in off-topic.

i was wondering if this would get a topic here :P
lik sang was a great site, and the only one infact that I used to import stuff.

this really wouldnt be a big deal of sony wasnt claiming they did this to protect their customers, if they were honest about looking out for number 1- I wouldnt mind.
but claiming to be looking out for their customers while they fuck them over is just despicable

I agree. I hardly ever see a company claiming it's looking out for the customers by litigating against another company.

So London has ruled on the issue, that's just one country... is that a reason for Lik-Sang.com (a company I've never heard of up until now) to stop doing business in this avenue?? If Lik-Sang acquired their merchandise in a legal fashion, then who is Sony to boss around this other company, telling them to whom or where they may or may not sell the products?? If Sony has a contract in place determining the limitations of their retail operations that's a whole other story, and I'll admit that I'm not well informed with this particular situation.

What hubris, Sony! Don't you control your own business and distribution channels (control of where your products go and for how much in wholesale???)? Why is this even an issue? Because of safety standards/etc? These customers are choosing to import hardware. I think they understand the risk, or at least the word would get out if their products were defective.

As far as the claim about trademarks and images, that's bullocks. If I were to sell some hardware, do I not have the obligation or at least an interest to include photographs of what I sell if not to be honest but to get more business? This judgement baffles me.

Score one for socialist corporate tyranny.

well, just so you know pep, lik-sang was one of the first and most trusted import websites for gamers..

and from what Ive gathered sony took them to court in the UK, when lik-sang is completely based in hong kong - they failed to show up at court

Thank you .TakaM. I took some time to read up on the official articles and see what some of the game sites were saying. Sony employees benefitted from getting their products, as well as third party developers who wanted hardware from Lik-Sang. And all of that game licensing money goes back into Sony's pockets anyways.... Sony doesn't have the balls to tell its customers that they want to rip them off.

I appreciate what Wolverine is saying. Ultimately you should be able to choose for yoursel if you want to buy from local Sony-approved retailers or from international dealers that want to offer you a deal. So long as Sony bullies out the competition, expect the prices on these devices to go up. It's a precarious position, considering the status of the console wars. This is the last thing I think Sony ought to be doing.

That's because in this situation most of them have the balls to admit that they're chasing the foreign buck.
